I really don't know. You might consider the board of realtors as a source if ethics are involved in addition to others suggestions. They handle things in house where I am. That could help before you face an appraisal board or file a counter complaint.

I have no idea how it's a licensing matter. I don't think they have jurisdiction, but i am now being asked to defend my file because of this complaint.

Something is getting lost in all of this. How is an ethics complaint tied in with an appraisal report?

I am truly trying to understand this. You need a workfile for an appraisal you completed as a trainee because your former boss filed a complaint about that appraisal, one that he most likely signed?

Your former boss is mad because you are now competing with him? You are actually getting work as a person who just passed the test and got certified in the last year? AMCs are actually using you for reports given that you have only been certified for less than a year; I though no AMCs would take anyone with less than five years of certification. I realize you worked for him for a long time.

She has been certified for less than a year. i would imagine the complaint is related to a report prepared after she received her certification. My interpretation is that it is not an ethics complaint but some kind of 'make your life miserable' appraisal complaint. Although the motivation behind the complaint is likely the ethics of her now being the competition.

As for the work file, it seems to me that the work file and complete report for an appraisal prepared less than a year ago should be pretty easy to interpret. If there is something in the report that should be documented in the work file and is not documented in the work file provided by the guy then she should be able to tell he left something out. if that happens she can deal with it and file a complaint against him for not providing the complete file. But i see little value in complaining that he pulled something out of the workfile until she actually looks at the work file he provides.

And with the "massive shortage of appraisers" i am sure there are many AMCs willing to accept her work.

Yep, ask politely for a scanned copy. I still think I would talk to the board of realtors depending on the allegations. The ethics thing is bad. The board of realtors could help on ethics allegations.

Maybe did he just make some threats about what he was going to do in the heat of the moment? He terminated you and obviously there were issues. Usually these things tend to blow over once people let their emotions calm and realize filing complaints, getting lawyers, making mountains out of mole hills, etc really isn't in anyones best interest. Straight time wasting is all it is.

Yes you get the original work file, if he scans a complete copy its good enough. You can't call the police to run the copy machine. Let time do its thing and in another few days hopeuflly you both can move on and get back to making money and being appraisers. The World still spins..

He always had the option to sweeten the pot if he wanted you to stay. I have very little respect for employers who think they own their employees and harass them when they leave.

How would he even know who your clients are now? I agree - if this were the old days, then I never would have tried to market to my boss' mtg broker clients (we had that verbal agreement from day #1). But as it is today, AMC's aren't clients, they are middlemen, nothing more.

Regardless, with every AMC I have ever know, it has been the appraiser's name on file with them, not the company. Employees of any firm can leave tomorrow and call up AMC's and simply give them a new email and address/bank acct to send the checks.
