New MLS Photo Requirements

    New directive from my local board:

    MLS Rules and Regulations Change Notice – Effective May 1, 2012

    The Directors of the XXXX have implemented changes to the MLS Rules and Regulations.

    ►Summary of May 1, 2012 MLS Required Photo Rule Change –

    Section 1.2.4 Photos, Sketches, Renderings, Depictions or Virtual Tours on Listings Filed with the Service:

    1. Effective for listings with a list date of May 1, 2012 Residential Single Family, Condominium, Multifamily, Lease properties (excluding properties that are under construction, to be built and vacant land) that are listed in “EXCELLENT” Condition will require a minimum of “10” photos to include the exterior front, exterior back, all baths, kitchen, living room/den and master bedroom. The first image slot must display the exterior front of the listing and be a true representation of the existing structure. The first “10” required photos must appear in the MLS listing within 72 hours, unless written documentation requesting a photo not be submitted is signed by the Seller and submitted to the MLS.

    2. Effective for listings with a list date of May 1, 2012 Residential Single Family, Condominium, Multifamily, Lease properties (excluding properties that are under construction, to be built and vacant land) that are listed in “NEW”, “VRGD”, “AVG”, “FAIR”, “POOR” Condition will require a minimum of “5” photos to include the exterior front, exterior back, main bath, kitchen, and living room/den. The first image slot must display the exterior front of the listing and be a true representation of the existing structure. The first “5” required photos must appear in the MLS listing within 72 hours, unless written documentation requesting a photo not be submitted is signed by the Seller and submitted to the MLS.

    3. Effective for listings with a list date of May 1, 2012 Commercial properties (excluding properties that are under construction, to be built and vacant land) will require a minimum of “1” photo. The first image slot must display the exterior front of the listing and be a true representation of the existing structure. The first photo must appear in the MLS listing within 72 hours, unless written documentation requesting a photo not be submitted is signed by the Seller and submitted to the MLS.

    Interesting. Maybe I'm paranoid, but does anyone else see where this is heading?

    No more untouched glamour shots for RE agents? Required photos of their cellulitic ass and high thigh fat along side their head shot from 1990 on their business cards, For sale signs, and billboard ads?

    In my MLS only MLS members are allowed to use the photos and it is suggested that approval is granted from the listing agent. Most of the photos can be found on the agents public web sites and other pushed and pulled sites. Re-listing with another agents photos is a big no-no, but many do it. A 2 year old photo generally does not relate to an appraisal.

    My MLS offers Realist data as a "Tax" report from CoreLogic. When you open the Realist report, there are MLS photos along with the rest of their public records, AVMish info.

    Yep. These photos are being used for other valuation products, including evaluations for banks, AVMs, hybrid products, etc. And the more photos, front, rear, all baths (sound familiar?) adds credibilty to these reports.

    Other Reasons to Support the Repeal of these New Changes to MLS Photo Rules & Regulations:
    -Not all listings, even in excellent condition, warrant 10 photos;
    -Excellent condition condos don’t always have REAR & yard photo opportunities;
    -Real estate agents are small business owners and professionals with the good judgment to select the photos that best highlight a property;
    -Agents who are not professional enough to post adequate photos will be punished by the market, naturally. We don’t need this level of babysitting accomplish what will occur on its own; and
    -Not all bathrooms were meant to be photographed & baths as a rule are difficult to photograph.

    I just wish RE agents required annual CE included a class on right and left. If not for GPS, no one could ever get to a property via their directions.

    That's part of the push to clean up the data. In years past putting an address in the MLS was about all many Realtors would do. Now with so many companies using the data from the MLS for various purposes local boards are feeling the need to push Realtors for accuracy. Data is money.
