Condominium (wood vs carpet)

HOA can set rules anytime.
If builder bought when wood floors were allowed, he has justification to complain. Hope he has photos to prove he was grandfathered in.
 
So far most of the discussion hasn’t been very helpful. Some of that is my fault for not stating up front my client is the HOA and not the builder/seller.

The biggest issue is looking at comparable sales.
1) Do I look outside the complex to look for condominiums with wood floors? I don’t feel entirely comfortable with that.
2) When you are appraising a house do you take wood floors into consideration with regard to quality? And if you do how do make that adjustment.

I just have to make a reasonable and credible argument one way or the other when I get cross examined. It may be frankly….no data to prove the case one way or the other. But I need to look at all options.

The rules have always been NO WOOD FLOORS! It is a sound issue. They were in the HOA documents. The guy doesn’t have a leg to stand on.
 
Yes. Builder is not my client. HOA is. This property sold. Talked to buyer agent. Listed for long time.
Didn't the buyer read the condominium documents before purchase?
Many condo bldgs have wording indicating no wood floors on upper floors.

The original buyer is the builder who put in the wood floors. The documents said from beginning NO Wood FLOORS. The new buyer is putting in carpeting.
 
I think for my condo five years ago, I paid less than $2,000 for about 600 sf on second floor from Home Depot. Cheaper carpet for my rental.

Regardless of original buyer, NO wood floors should be in the condo.

That was five years ago. Also this is a higher end condo. Home Depot carpet will not due for these folks. And there are not big box stores close. So not an option.
 
Reminds me few years ago. I suspected a roof leak so HOA sent roof contractor.
If there was a leak, HOA would have fixed it.
Since no leak, I had to paid for inspection service. I didn't know that or I didn't read the condo docs. It cost $500 from the roofer. WTF.
So I went to the board meeting and we split the cost.
HOA board has discretion.
