Defective paint question

Hi all - I'm doing an FHA purchase that has some minor chipping/peeling paint on the exterior. I told them they would need to correct the paint per FHA guidelines. They are apparently doing a hold back as the weather here in New England(single digit temps) prevents them from doing the repairs now(their words not mine). I just want to make sure I'm covered here - do I still have to do it "subject to" the paint or can I state there is defective paint and do it as is with a cost to cure?

If the home is pre-1978 built, you will have to condition the report as subject to.
