Just got a surprise today. I have always been under the impression that if a lender wanted sample appraisals that I had have the permission of the Client to share the appraisal. A freind called the Board and talked to their attorney. She said that since both Lenders were covered by the Privacy Act that we did not have to have permission and that we could send samples at will.

Is anyone else surprised at this?

Get it in writing,

Preferably signed in blood

So you can do a DNA test if/when someone tries to take you to court

Heck YES I'm surprised!

I wouldn't chance it in MY home state, there were 3 board members in attendance (or instructing) my last USPAP class and this was covered as being in violation. I am an informed (even if wrongly informed) user of the "my state rules version" of USPAP
