Usda New Construction Thermal Code Requirements

I have a lender asking me to verify that a new construction home meets the USDA thermal code. According to the USDA website, the builder or an engineer is supposed to verify this requirement. The lender is passing it on to me saying "all the other appraisers do it". Anybody else verifying these requirements?

I would reply with something along the following:
The appraiser is not a licensed engineer or contractor and is not qualified to made determinations as to whether the home meets specific energy or other client required building specifications. Further the client's own regulations require that such determinations be made by such licensed individuals. The appraiser provides and estimate of value for the property only. As this request is outside the scope of the appraisal and outside the licensing and available services of the appraiser, the appraiser must decline to provide such service.

Are homes in your area built with permits from a local authority and code?

The only way "You" can verify; is the "Certification of Compliance" provided by the "Engineer/Archt." as required by the USDA; actually, the Lender/Client should have provided it to you under their due diligence of compliance. Why would they even entertain Lending without the USDA thermal code of compliance requirement in place ??

For FHA that is form 92541, it's required to be filled out by the builder and is expected to be sent over in the appraisal. You might ask them if this is what they are referring to... Good Luck.
