The bottom line is that the departure provision of USPAP is enough for any governmental agency to claim a jurisdictional exemption. Also, USPAP is not a government control, but rather a set of GUIDELINES issued by ASB, which is not a government entity per se for appraisers primarily for FEDERALLY FUNDED LENDING. As such, there are a lot of occasions where appraising will depart from USPAP. This can lead to problems such as occurred with BLM, but that's just life.
On the original question the ASB cannot compel any one to comply with USPAP, nor can they exempt anyone from compliance. The USPAP document does point out that you can be compelled to comply by law or regulation, required to comply by agreement (with client or intended users), or you can comply voluntarily.
It is my understanding that Florida is strict. If you are licensed, you must comply with the current edition, by law.
