DW vs Site

Realtor listed and sold a Double Wide with no mention of it being a manufactured dwelling. Homeowner didn't reallize it was a DW until he was living there for several months. HO contacted the Realtor who advised it wasn't her problem - told him he should have known. Contacted an attorney who told him it wasn't worth suing over.

Does this fella have any recourses? Property was bought in July of 2012.
 
It would depend if he was damaged or not. Has an appraisal been done that shows he paid too much under the pretense that it was a site built versus its actual construction?

Of course the appraiser brought it in at sales price - HO never got a copy of the appraisal - and probably will not be able to.

Purchased for 165K. Neighbohood supports 165K for site built.

Homeowner is entitled to a copy of the appraisal by law.

The Realtor is required to disclose the property is a DW by law.

It's been well over a year - some lenders require a request in writing within 30 days.

I agree - the Realtor should have disclosed it. The h/o was blindsided. Is there any recourse at this point?
 
In this area may people also call a modular ranch home a double-wide. So, first it has to be determined it is is truly manufactured or modular? Many agents either do not know the difference, don't want to know, or call anything made with lumber stick built. Just because it has steel runners under it may not mean it is manufactured as there was a manufacturer of modular homes that had very similar shipping stringers that were not always removed removed, rare but another thing to check.

Once he figures out what it is , then he should get a NEW Lawyer.

Often in cases of fraud the award is treble damages; Sanctions against Realtor; Sanction/fines against lender; fines against original owner.

This is a deep pot. There is plenty of gold in that bucket of Crap!
