Law firms are preparing lawsuits against AMCs for exploiting consumers, and indemnity agreements will not protect them. When the attorneys find this has the approval of GSEs and HUD, expect major financial consequences. Stay tuned.

What Are Appraisal Management Companies (AMCs)?

Appraisal Management Companies act as intermediaries between lenders and appraisers. Their purpose is to manage the appraisal process, ensuring compliance with federal regulations and providing an unbiased estimate of a property's value. While their role sounds important, AMCs often add a layer of unnecessary expense to home purchases.

The Problem With AMCs

The issue lies in how AMCs charge for their services. These companies frequently bundle their fees with the cost of the appraisal, leaving homebuyers unaware of the inflated charges. Instead of paying directly for an appraiser’s expertise, buyers may unknowingly pay an additional premium for the AMC’s involvement. This lack of transparency makes it difficult to identify how much of the fee actually goes to the appraiser versus the AMC.

For example, a standard home appraisal might typically cost $500. However, with AMC involvement, the total fee could rise to $800 or more—a significant increase that buyers are rarely informed about.

Why Are Hidden AMC Fees Concerning?

Reasons that consumers are skeptical about AMC fees can include:

  • Lack of Transparency: Buyers are not clearly informed about how much they are paying for the appraisal itself versus AMC services. Some states require the fees to be disclosed separately in closing documents, but there's no federal mandate in place.
  • Inflated Costs: The involvement of an AMC can drive up the price of appraisals unnecessarily.
  • Limited Value Added: While AMCs claim to offer efficiency and compliance, their services often add minimal tangible benefit for buyers.

What Can You Do to Protect Yourself?

There are several steps you can take to try and avoid unnecessary fees when purchasing a home.

When reviewing your loan estimate or closing disclosure, inquire about the breakdown of appraisal fees.

Also, be sure to do your research. Understand the average cost of appraisals in your area to identify potential overcharges.

When all else fails, contact Morgan & Morgan. If you believe you’ve been unfairly charged, consulting an experienced attorney can help you determine the best course of action.

This could actually go our way, somehow, sometime. Who knows? The American tort system is a lottery. The only way you’re guaranteed not to win is to not buy a ticket.

For consumers who have been defrauded by AMCs, which includes anyone in the US who has taken out a loan in the past decade or so. Here is a link to local attorneys.

Morgan and Morgan? You mean the guy who has his own billboards defaced as a publicity stunt?

Can everyone clap. Oh wait, hard to clap when dead and buried. But even the devil getting a smash in the face can be fun to watch.

The lenders have disclosure obligations to the borrower.

Where is the fraud? The lender discloses what is required. The AMC has no obligation to explain anything to the borrower. Just more useless jabber about AMCs. This is just like Charlie Brown and his desire to kick the football.
