And wont the courts have the final say then?
Courts always have the 'final say' on what laws mean under our constitution. (Except when Jackson was president.) That is how the process is suppose to work.
 
Obviously there needs to be standards and ways to measure competence and experience however I have found that within every elite whether it be military, intellectual, athletic, ethical etc. there are weak links, bad actors, and those who have no business being within that elite. To tout membership within an elite as proof positive of anything is arrogant and easily dispproved with volumes of evidence of failure among its members.

Regardless of how the FHA rules, humility, and respect for our colleagues is never inappropriate.

There must be standards as imperfect as they may be. I respect anyone who has labored at this profession honestly and nobly but I also respect the necessity of FHA to set standards to find the most able and capable among us.

Although "certified" is no guarrantee of competence and ethical behavior each requirement limits the number of incompetent and unethical that gain access.

All that being said I believe this is a symantic problem that will be resolved by including licensed as well as certified.
 
I think the problem started when the FHA lowered its standards by just letting appraisers apply for the roster and not having to prove they are competent to do FHA appraisals. Maybe the congress is just trying to fix something that the FHA broke. I don't know.

In this case HUD is not the one setting the standard. The law was created by congress and their lobbyists. HUD does not have a choice (only interpretation) in the matter.

What license level do you all believe has been found to put the Department most at risk? More on that in the future. You are all in for an awakening...

I don’t know if you still remember me but I remember you from when we both were doing appraisals as independent contactor for Santa Ana HUD at the 5th floor of #3 Hutton Center. I guess it was 1994. We used to chat about our common contacts Kate Walters and Durgha if you still remember them. I am sure both of them are retired now but both were very fine ladies.
I am a little late to this thread but there was another thread with the same subject but different title prior to this one on the other forum that I posted several times and I got frustrated of constant generalization on the license, certification or designation. In the below post, the person that I mentioned as a prominent, competent appraiser with good skills was you but I tried not to mention the name or the place. I know many competent appraisers who are licensed and many incompetent appraisers who are certified general. You just cannot generalize.

I think all appraisers doing FHA appraisals (licensed or certified) should have to get the FHA merit badge. Maybe a 2 day course that doesn't "teach the test" but teaches the proper protocol, followed by a real test, not given by the wink and nod CE/Prelicensing instructors that have been spitting out appraiser wannabes recently.

I taught an FHA appraisal class for Mckissock in 1999 nationwide. It was 2 full days and could have been longer. That was with the new(at that time) 4150.2 handbook. Now with all the changes, i believe that anyone who does not take such a class, having never taken a class in FHA appraisal before, does a disservice to their clients as well as the buyers and sellers.

I would like to see FHA require such a course(2 days), and a test, and then "Certify" anyone who has taken the course and successfully passed the test. Of course that will likely not happen as they are not a nationally recognized appraisal organization.
 
Don: I still take the 7 hour FHA course ever year just to "brush up" my FHA appraising skills. I learn something new every year. It is jut amazing how many people have not even opened the book or even have a copy of the FHA guidelines. I would have no problem seeing such a 2 day course and test with mandatory updates every 1-2 years!! ( Do I get a kick back for promoting instructor/fees?)

Bingo!!!

It is exactly correct to say that the FHA caused Congress to do something, because it is patently obvious that the FHA was not doing their job regarding only allowing competent appraisers to do FHA appraisals. That being said, the new law is idiotic and does nothing to address actual appraiser quality regarding FHA appraisals.
