Weird dock situation

shuold I just give it back due to owner prerssure as the excuse.... a marginal client I could care less if I lost them

You might or ask the lender to clarify whether they wanted the dock included and to provide a deed to the dock/riparian property

It is not up to lender what they want though if they can provide me with a deed for dock then it gets included.

I just hate this assignment now and might give it back. Idk I have only given assignments back maybe 3 x in 20 years but sometimes is worth it. Each time involved a crazy or pressuring owner or RE agent.
 
I would like to give assignment back at this point, though I can finish it, bring it in for $ OMV that it is supported , say that due to lack of evidence on a deed or real property tax card the dock is treated as personal property and if he is unhappy well..let him prove the dock is real property and deeded.
It seems to me that such an approach comes with risk. What if the borrower is savvy enough to cite SR 1-2 and note that it is the appraiser's responsibility to identify the property characteristics??

I looked up the QC deed and see it was recorded as for the dock -
however it was for $!0 !!
And the fact that the property clerk recorded it as a QC deed, does that make it part of the real property?>

It seems like it is a deed transfer for the dock alone and the present owner can go on to QC deed it someone else or sell it if want to...

Probably back to the same guy who "sold" it on the QC deed for TEN DOLLARS when owner tells me the dock is worth 100k...When I asked owner, can the dock be sold separately he said yes. So even though it has a QC deed recording it, is the dock real or personal property?
 
Well if it is above my skill level to definitively identify property characteristics I will give it back, no charge to owner or client of course.
 
This has to be lake front. It can't be ocean front. Does Florida have rivers? Don't give it back. Don't do it.


The lender don't have to lend on it if they don't want to.
