1004D Final

I recently did a 1004D final inspection and there were a few items in Escrow Holdback; Final Grade, driveway, bury sump line.
I did the inspection and marked the form as Complete, although these items were not finished. The lender has come back and asked me to update the 1004D to reflect the escrow holdback items still need to be completed. Do I change the 1004D inspection to Incomplete and uncheck the "Certificate of Completion" box? Do I note these items in the paragraph below? Please help. Thanks.

Well if the items were part of construction agreement. It wasn't really "complete". I run into similar incomplete items regularly. I always check the no box and list what items are incomplete. It is up to the lender to decide what they will do. Mine always escrow. Most of the time it results in another 1004d when items are complete. Easy money since it is usually just external items. No reason to uncheck the certificate of completion box. That is the report your are providing. Whether complete or not
 
I recommend revising the 1004D as you describe. Provide a note that the change is made, effective date, and current date for clarity.

You shouldn't have.

The fact that the lender has agreed to escrow funds indicates they know the property is NOT complete but intend to close anyway. The 1004D should reflect that. If they need a 1004D to reflect completion, they will order one. I've seen them as far out as 2 years after closing.
 
you can say complete except for the following items noted. not sure, but the lander wants incomplete with the items noted to be finished in the block below. when confused, ask for the exact answer you need with your question asked.
 
When you are completing the 'Completion Certificate', you are eyes. You aren't part of the Lender's decision making process. Report what you see. Period. If the improvements aren't 100% complete, report the items that remain undone. It's none of your business whether the Lender has escrowed for the incomplete items or not.
