Closing Statements and AMC Fee

Zoe believes it will increase fee's a lot..Just ask him ! and so have many others over the last few years.
It would change the market structure. I know it would. I won't swear it would not make a lender bring the appraisal function back in house. It would bypass fastest and cheapest incentive to an AMC because the AMC fee would be disclosed on front end to the borrower which would create intense competition on fee between AMCs.
 
You don't get it. The AMC has no part in the appraisal fee the lender sets. The AMC fee is what the LENDER pays them. The appraisal fee the lender collects is set in stone. It is not going to change....just like a credit report. It is between the lender and borrower. Once the lender is ready to order an appraisal, THEY choose the AMC. There is no reason for the closing statement to show what the AMC received. The borrower knew up front what the appraisal fee was and they paid it to the lender. Some of us have been in dozens if hot hundreds of closings and or sat in the closing as a buyer, seller, listing agent of selling agent. I have been at the closing table close to 100 times in one capacity or another. NEVER have I heard anyone question the appraisal fee, because it was set and paid long before closing. Some appraisers think AMC fees are a big issue with buyers. It is not. It is only a big issue with appraisers who are either new, have a slow workload or are not trying to negotiate higher fees. Appraisers want higher fees coming to them.....I am not sure many of us are worried enough about the borrower to give them money back. A current issue is that Trump and those in the administration say they want to lower the cost of buying. I fully expect appraisal fees will be one of the targets.

It has to do with transparency to the borrower and the intent of truth in lending act. The fact is if AMC fees were separated on good faith estimates to borrowers, it would change the market structure. AMCs would have to compete against each other on fee.

A lender don't have to use an AMC. Many lenders don't use AMCs. With lender that don't use an AMC, the appraisal fee they put on truth in lending disclosures is the appraisal fee to the borrower.

AMCs have market power on price from commingling of fees, which is where antitrust violations occur. I promise you that you don't more about truth in lending and the regulatory environment.

It feeds a fastest and cheapest mentality with AMC because they get a cut many times from the lender with the fastest and cheapest appraiser. The lender gets a cut too if they own part of the AMC.
 
Portable appraisals would help borrowers not get locked into one lender. Client would be anyone using it and appraisers not involved in the transfer. Just like now lender sells loan to other lenders or GSE and appraisers not even involved.
 
The kitchen is getting hot. If you can't take the heat, get out of the kitchen.
