FHA New Construction As-Is or Subject to

FHA new construction is complete except for touch ups and landscaping in the rear (it is graded away from the dwelling) that is currently just dirt. I asked my client and they have been unresponsive. I would assume subject to and also meeting FHA minimum requirements for new dwellings since someone does not want to buy new construction with needed work that is expected before they buy the property/contract.
 
If the final grading and landscaping is part of the contract. Than it is not "complete". Just finished 3 1004D finals (not FHA). None of them had final grading or landscaping. Marked it no and explained. Lenders usually escrow a set amount and close. Especially this time of year. Not doing much landscaping during the winter months around here. Sure it is same in Maryland. I eventually get another 1004d when landscaping is complete. Easy money since it only takes and exterior inspection.

Would you mention the touch ups in the subject to as well? Obviously these are expectations of the buyer for the builder to complete this.

I will generally mention them. But they are typical in any new build. Little pieces of blue painters tape everywhere. I do not generally make them a condition unless it is a somewhat major item. Like maybe a bathroom mirror. Another problem I have run into. Is closings with some somewhat significant finish items incomplete. Due to material shortages. Had a couple close without the kitchen backsplash. The tile was on back order. Another was missing range hood. On back order. They closed them anyway and escrowed. Same thing with light fixtures and some hardware.
 
Working on one now. Missing a bathroom mirror and a doorknob. Planning on doing it "as is" and just mention in a comment that they are less than 1% of the value. If they come back to request 1004d then so be it.
 
Few contracts here include any "landscaping" and normally state a small allowance, perhaps for some turf in front. Usually mention and go on - the bid is for the house, not the landscaping.
