Hi,

I got a buddy and it looks like he's going to get his appraiser license revoked forever. He also sells real estate as well.

Will he lose his real estate license automaticaly because of the appraisal violation.

It is to be noted that he was NOT selling or lending on the property that the fraud was committed on - He just appraised it..

ALSO - can a person lose their apprasiser license because of something they did selling real estate that had nothing to do with an appraisal.

Thanks,

Concerned friend

Unfortunately in Texas you can get caught committing fraud and forgery under an appraisal license and still get a Real Estate Broker's license. I know a case where this happened. This individual was caught forging a certified appraiser's name, falsifying his experience log, and being obviously incompetent. Was allowed to voluntarily surrender his license. After he lost his license he was caught sending a forged license to another state to get a reciprocal license. When he applied for his broker's license he was able to truthfully say that he had not had a license revoked because he voluntarily surrendered it. The Texas Real Estate Commission says they don't have any jurisdiction over the appraisal violations. So now this person has a broker's license. So much for protecting the citizens of Texas.

Tom:

Friend or not, why would you be concerned about someone who committed fraud in one profession could keep their license in a closely related profession? There are already plenty of fradulent realtors out there.

Under Arkansas law, if you hold multiple privilege licenses (appraisal, real estate brokerage, securities, insurance, surveyor, etc.) and lose one through revocation or suspension by a state regulatory agency, you have 30 days to report the revocation or suspension to all other agencies who have issued licenses to you. The other agencies then have the right to initiate their own complaint against you if they deem that you lost the original license due to fraud, moral turpitude, etc. If you don't report the disciplinary action, then the other issurers may terminate your other licenses for not reporting the first action.

Basically we take the position that if you aren't competent or of sufficiently good character to hold one license, then maybe you should not hold any others. The moral is "Don't screw up!".

In WA I believe you're required to report this to the licensing department, but honestly I can't say that with certainty.

However, the fact someone's appraisal license was revoked due to fraud is not going to bode well with their real estate clients should they find out! They'd definately being operating at a major disadvantage to their competition.

It is not automatic in my state, but yes...then can revoke your brokers license if you have your appraiser's license revoked and visa versa.
