Breaking News: Mark-ups violate RESPA, 2nd Circuit Court says
In ruling on a RESPA class action suit against Wells Fargo on Friday, a federal appellate court has made a groundbreaking statement that mark-ups do violate Section 8(B) of RESPA, a decision which goes against years of court precedent.

Sounds good, but the 9th turns everything around. :D

It's a start, and we can hope for some confirmation. But you know..... if only AMC's would actually sell their OWN services, rather than trying to skim their bucks on the vendor's bills, they might actually be able to sell a real professional service.
 
Now why would HUD want to take this to the supreme court?

Frankly I dont think the supreme court will hear this. Just not quite important enough in the grand scheme of things.

"Will HUD take mark-up issue to the Supreme Court?
The Second Circuit Court of Appeals' decision in Kruse v. Wells Fargo, released Sept. 10, may well have opened the door for the Department of Housing and Urban Development (HUD) to take the question of mark-ups all the way to the Supreme Court. (more)
 
HUD may want to take it to the Supremes to get a decision that applies across the country.

Isn't it part of the Supreme courts job to resolve differences of opinion between the lower federal courts in order to have Federal Law administered consistently across the country? But I don’t think they will look at it unless someone asks them too.
