USDA We measured 32 ft. from well to septic.have a question.

Good Afternoon,

We had measured only 32 feet from a well to a septic. It also needed some painting. Anyway, last I checked according to requirements, that is not far enough from the well to the septic for USDA or the state. I received an order to do a final inspection on this. I spoke with the Division of Ground Water Protection today and he told me that he's been contacted about this property a lot lately and that he couldn't find paper work on it. However, the home owner order a water test that he is going to do next Tuesday and he was told that if the water test is o. k., they are going to pass the loan??????? I just left a message with USDA. comment?
 
It's your job to make clear that the well & septic tank are 50' apart and that the well & drainfield are 100' apart and that the well is 10' from any lot lines (or require a survey to prove any of the above if it's in question).

From there it's the lenders problem, not yours

I had asked for a survey and nobody had one (so, I should have required one!-that's what I forgot to do-oh no!). So, now what?.....I should tell my client that I should have required one change the original appraisal to require that along with the needed painting and resubmit the original report? Then when I go to do the "final inspection", even if the required painting has been done I still can not say that the property meets USDA standards if I've still not been supplied a survey to show the well and septic are at least 50 feet apart and repeat that I had measured only 32 feet from the well to the septic at the time of the original appraisal appointment?
 
You don't need to automatically require a survey, just if the distance is in question (you sound pretty sure it's 32 feet).

Simply state it doesn't meet HUD guidelines because per your measurement they're 32 feet apart.

The underwriter/lender can pursue a waiver if they like. At that point the ball's out of your court.
 
Thanks!, that's what I did. I didn't know that they could possibly get it approved anyway with a waiver or something. wow.
