Defendant in Civil Court Case

Contact your E&O carrier and seek their opinion and advice. Many times attorneys will go on fishing expeditions to see who responds and what kind of settlement offer they can obtain. Chances are good if an experience attorney gets involved as your representative and starts questioning the complaining attorney they will back off or limit your need to respond.

So what do if they jack your rates a bit, it beats being defaulted or being found negligent and ordered to pay a significant amount of restitution.

Did the notice require you to appear or did they include a request for your work file and a copy of the report?

of mailed summons and take their advice. Ignoring it wont help the situation and yes in some States you can be mailed by first class.

Yea I contacted e and o today, just to appear nothing else

Sometimes they just want you to read your report or parts of it into the record.

They listed the appraiser as a defendant.

Do you want to commit perjury on the stand when/if they ask you if you received the summons? Not worth the risk.

He has opened and read the letter. He can't undo that.

Not sure when I would be on the stand? Are they sending another request via Certified Mail?

I don't recall counselor. Was it sent Certified Mail?

(Can't be undone but my memory ain't what it used to be)
