Too Bad

Guess what. An attorney from the enforcement division of the OTS wants to talk to me. I will be happy to honestly answer any questions that they have. Thought you guys might want to know. Maybe there will be some justice someday.
They probably just want to ask you to shut up. The feds have demonstrated that they have no interest in enforcement. It really does suck, doesn't it?

Maybe things have changed. I hope so, but doubt it.

JenniferW,

I think you will be pleasantly surprised. My dealings with the OTS have been very direct, courteous, and straight forward. At least with me, they have been comfortable in asking all questions and have been very transparent in my dealings with them.

The truth, the whole truth, nothing but the truth and stick to the facts. Who knows, you may do more for the entire profession than you mght think.

Best,

Brad

UPDATE:

I hope someone notifies JC California of the recent developments.

We have now won 2 of 2 motions, and this one wasn't really expected. I think we were just prepared for the worst anyway. They immediately got the case moved from State Court, where it was originally filed, to Federal Court. The first motion that was heard since then was filed by them to try and move the case to Washington State, and the Court denied it. The second more recent motion was filed by my attorney to remand the case back to State Court. Getting it remanded to State Court was very important because State Courts are a lot less likely to dismiss the case, and in State Court only 6 out of 9 jurors have to agree on a verdict (Federal is 6 out of 6). The case is now in California State Court, in Sacramento, Ca. In case there is someone who is not aware, Sacramento, Ca. currently has one of the highest foreclosure rates in the county, and we are perceived as having liberal judges and jurors.
