You may want to try using GoogleEarth's measuring function - less any observable overhangs to measure the house from the sky (assuming your area of interest has sufficient resolution to attempt that method... )

And I'd use any available spy in the sky views available from other systems (microsoft maps, etc) to see if I can peek into the back yard and side yards for other views...

Xiaomei Zhu - the advice to acquire legal representation is very good, and I'd ask around about who is GOOD and not too too expensive before securing that representation. Agreed that the gent writing the letter is mostly just fishing.... but he *may* have at least one hook into you.

Uh putting into the scope of work who the ONLY intended user and what the use is may mitgate some but it really depends on your court/jury and soooo getting a good legal offense is probably your best defense (after the fact).

It really is best not to apply 2055 use to anthing you can't readily get out of...

Lobo - trust the force - follow your feelings! If it really feels bad - walk! On the other hand we did several exterior 2055's for the IRS under specific instruction of NO CONTACT and had no adverse repurcussions from those attempts to value what we were guessing at... but there were a LOT of disclaimers in the reports. And we always stated that the intended user was sophisticated and knowledgable, and reserved the right to form a different value opinion if ANY of the assumptions in the report proved to be incorrect. Stated source and level of reliability beliived to be placed on all data, and etc etc ad nauseum.

E & O may not be required in Texas but this situation is a good example of why it's needed. We are easy targets. Good luck.

Not saying I disagree, but there is a good chance the lawyer won't think it's worth the lawsuit if there isn't a policy to offer a quick settlement. Having an E&O policy makes you a target just as much as it protects you.

Maybe you should just tell the lawyer that you don't own any property and you don't have E&O insurance. :Eyecrazy:
 
This is one of the main reasons I won't do 2055's, if the client insists that that's what they want I tell them OK, I have to go inside the house, measure and take interior photos and it will be the same fee as a 1004.
 
Not meaning to steal the thread...but because the OP apparently displays his or her real name--could a lawyer use Forum posts--the original post as well as the peer responses--in an attempt to prove that an appraiser's methodoloy is suspect?

In this particular thread the OP is asking for advice concerning the best recourse in response to a potential claim, but several posters--ostensibly "one's peers"--question the substance of the SOW, absence of extraordinary assumptions, etc.

I just called the lawyer yesterday. Sounds like he has not read the whole appraisal report and does not understand this is an exterior only appraisal. I explained to him the scope of work, intended use/users. He asked me to fax him the order request of appraisal from the lender, handout from the listing agent and its MLS listing. I feel he's helping his client to get someone to blame for but he's not knowlegable enough. After talking to him I feel much better. It was a fishy letter. Finally he said they will ask county appraisal district to change sqft. I told him when I was doing this appraisal 3,900 sf is the only number we could use, even the listing agent used it. If the seller knew this is wrong he should have told the listing agent. That appraisal was only for the loan purpose. Since they put a large downpayment, the lender just required a simple appraisal.

Hopefully I can get away from this.
 
Friend of mine received a phone call from the local police asking her to admit to a white collar felony so they could make the issue go away as quickly as possible. She admitted to the crime...and was handcuffed within 30 minutes.

Point being is that lawyers get continuing education for attending the "Deceit and Lies" seminars if the mortgage brokers haven't taken up all of the seats.

DON'T SAY NOTHING TO NOBODY. DON'T ADMIT ANYTHING.
