Vendor agreements with "hold harmless"

Much like having one foot on the dock, the other on an untethered boat drifting away and unable to choose whether to stay on land or shove out to sea.

Hopefully, FNC's time is running out.

My question is--if the FNC ship goes down, will the Captain do the honorable thing?

Q&A:
Appraisers who wish to preserve the formatting of their presentation always have the option to transmit their appraisals in the Portable Document Format (PDF). (Note: Appraisers should check with their clients prior to submitting a PDF; some lender clients require submission of files using the AI Ready™ Standard.)

Does AppraisalPort keep a copy of your appraisal after you send it? As part of keeping your appraisals secure, AppraisalPort keeps a copy of the appraisal long enough to assure that it was actually delivered to and properly received by the client (we all know that computers are not perfect). After the audit period, it is deleted. It is never shared with anyone. No data is stripped out, separated, or used for any other purpose.

Still, appraisers who are concerned specifically about that part of the presentation of the appraisal and how it might better reflect their intent always have the option to transmit a PDF version of their appraisal instead. AI Ready™, while preferred, is entirely optional with AppraisalPort. Remember that some lender clients do require AI Ready™ files. Check with your clients to be sure.

Really, it says I can pdf the report.

My red - to which I say "oh really?" Discovery should be MOST interesting, especially when the contents of the hold come to light............reload, mateys, reload with everything ye've got...ready.......aim...and fire again.......she's listing badly........and in the waters of her own making.............

Let's add more that is in that FNC agreement:

There IS a class action already to go forward and any appraiser that either signs this agreement or logs into AppraisalPort after September 12, 2008 will not be able to participate.

PLEASE have your own attorney read BOTH this new agreement AND this pending class action suit:

Those of you that agree to this and/or sign in to appraisalport after 9/12/08 will have signed away your LEGAL and CONSTITUTIONAL RIGHTS to the judicial system!

PLEASE DO NOT DO THIS.

Those of you that do this will be helping to KILL off all mortgage appraising -= yourself.
 
Ever wonder if the real/original truth in the new FNC agreement is to remove as many appraisers as possible from elgibility in the current class action suit? Anyone that logs in after Sept. 12th unknowingly removes themselves from elgibility to settlement? Never considered that it would effect the current legal situation, only protect FNC in the future. If the class has no legal participants, there is no class action? Am I not right here?
