Purchased Private Street - In San Francisco

since it was in a gated community i would bet even the dumb appraisers knew it was a private street. the report i heard said that the tax bills were mailed to the wrong address. i would think the tax collector has some responsibility for not researching all the returned mail a little bit better. and i would think the HOA and their accounting firm have some responsibility for not asking why we haven't paid that tax bill for a few years.

I still think that the owners will ultimately find out that they have fewer rights than they bargained for. Interesting case to follow. As I mentioned earlier, I was a court appointed appraiser for a private road case and the court ruling was not favorable to the buyers/new owners. They found out that their rights were about equal to adjacent owners that had a prescriptive easement over it.

Wealthy San Francisco homeowners get their street back

Angry homeowners on an opulent San Francisco street got their wish Tuesday when city supervisors Tuesday canceled the sale of their road and sidewalks at an auction held for an overdue, $14-per-year tax bill.

The San Francisco Board of Supervisors on Tuesday night voted 7-4 to overturn the sale of Presidio Terrace.

Michael Cheng and Tina Lam had purchased the mansion-lined, block-long Presidio Terrace in April 2015 for $90,000 after the taxes went unpaid for decades. Even with interest and fees, the bill only came to about $1,000.

Why good? The HOA should have paid the property taxes and the investor bought the street fair and square at the tax sale. The city should pay the investor the fair market value for the street as this is now a government taking from the rightful owner. The investor should definitely sue the city now.

Sale was final when you cashed the check baby. To refund your street I will need a returned check of $90,000 and a returned check fee of $1mm and interest @ 24%.

The investors who are the rightful owners of the street should definitely sue the city as they are owed compensation in the amount of the fair market value of the street due to this government taking of their rightfully owned private property. In fact, after this if I were the investor I would still assert that I am the current owner of the street and close it off to all traffic and/or inform the homeowners that all cars must be removed from the street within 72 hours unless they remit payment of $1000 per month per vehicle and then proceed to have any vehicles towed away unless the parking fee had been paid.

I'm on the side of the buyers. Hey, use the current social environment to your advantage. You didn't create the racism card...but might as well use it.
