Just received this email. Looking for the opinions of the rest of you. Think I'll send this in to the state Appraisal Board asking for their opinion. Of course, the names will be included to them. My opinion? Most of you already know. :twisted:

Hi - my name is ****** - I am the Managing Partner with *****- we are located in ****** County.

Would you be interested in doing business with ********?

A few of our local lenders are asking us to find appraisal companies throughout Florida.

We will NOT cut YOUR price.

If things work out we will order ALL of the appraisals in your area with you.

All we ask is:

Turnaround time be good.

If you cannot contact the borrower to set the appointment right away - PLEASE CALL US.

Check the value in advance if possible - we are not looking for an exact number but if it's not in the ballpark - PLEASE CALL US.

Don't finish the appraisal below value without calling us.

If you feel the need to put below average or poor condition on the appraisal - PLEASE CALL US.

The majority of the appraisals will be cut and dry, but there will be the occasional strange order. If this is the case PLEASE CALL US so we can work out the details prior to having the finished product at our office.

We look forward to doing business with you.
Please call or fax your price schedule, order form, license and resume to us if you are interested.

It seems as if they are asking for an appraisal ONLY if value is at or above estimate........hummmm....wouldn't that be contengent on reporting a predetermined value? How would one know what the value is untill data is collected and verified, Comps are gridded and adjusted??

I agree, let the state have a copy. 8) Don't know if they will DO anything, but they can't doubt that there is not a coercion problem out here in the real world.
 
Pamela, the only request of their's that is appropriate is that "turn around time be good". The other "conditions" are the same old deception, coercion, fraud and arm-twisting that we all know about. Sadly, oh yes, so very sadly, we know there are appraisers out there who will play their game and do for them exactly what they want, do lots of leg-work, and waste alot of time, and get paid few full fees....because they have not been able to secure a(ny) client(s) with integrity. So long as they find one appraiser to play-ball, they get to stay in business. What a shame, that State Boards and our Federal representation does not care enough to squash this sort of stuff like a roach under the heel of a heavy boot.
 
My wonderful Florida State Board already knows this. The problem is that so far it APPEARS to be legal for them to ask this of appraisers BUT,

it is ILLEGAL for the appraiser to accept these terms.

They are working on it and I hope this helps them.
 
Hey, don't be so hard on the poor people! All they're asking is for you to work for free. If you want to get paid, it's easy...just fill out the form the way they want it. You can't blame them...I wish my dentist would work for free, too.

There's no liability at all on their end...why wouldn't they try it?

That request (and almost every single one of mine) are why i think there should be manditory disclosure of ANY attempt to sway or influence the outcome of the order. When i get this request (RED FLAG) I inform the orderer (?) that i will not know the value untill AFTER i do my work.....Evaluate subject, gather Comp Data, view Comps and take notes, GRID the subject and comps......Sounds like and apprasal to me.......

Had one the other day ask for an "Eyeball check".......Mine are green and white, do you think that helped them?

I know that at least some of you will appreciate the reply I sent regarding this email solicitation. I received 2 more just like it so I finally decided to respond. (wish I could watch her face as she reads it!)


Dear *****,

I would be very happy to add a new client. There are a couple of issues that concern me regarding some of your terms and whether they would put me in jeopardy of violating the USPAP (Uniform Standard of Professional Appraisal Practice) that Appraisers must abide by. The terms you have presented that cause my concern are:

If you feel the need to put a below average or a poor condition on the appraisal - PLEASE CALL US."

Due to these concerns, I have forwarded this email to the Florida State Appraisal Board for their opinion. Since I do attend all Appraisal Board meetings in Orlando, I will also present this to the board at their next meeting on April 2, 2002 in hopes of being able to get a definitive opinion or ruling. I would strongly urge that you or some other company representative also attend so that any questions that the Board might have regarding your requirements or requests can be readily answered. If you need any further information regarding the Board meeting place, time and/or a nice place to stay if you need to spend the night, let me know and I'll be happy to assist you.

Even if you cannot attend, I will let you know what their opinion or ruling is after the meeting. Looking forward to meeting you there and developing a long and mutually prosperous association.
