Can I call owner on an exterior drive by?

AMC on engagement letter said I can't call occupant.
Yet the order has the owner name and phone number to contact.
I like to call the owner and get more description of subject.
Can I call owner? Also this is for a Preforeclosure assignment.
 
NO. Your contract with your client is governing your parameters here. And since this is for preforeclosure asset valuation, you can figure out for yourself why it specifically says not to contact the borrower.

On the other hand, if your 2055 was for a HELOC, then you must call the owner to get more information about the interior characteristics of the home, because that 2055 is going to result in a GSE loan.
 
Appraisers still do drive-bys when Fannie said you can't EA the exterior condition to the interior? I stopped doing that garbage product when they said you can't do that.

I got mixed signals. On one hand no contact and then AMC gives me the owners' phone number.
 
If your Client's instructions include 'don't call the occupant' and you accepted the assignment then, you don't call the occupant.

The engagement said do not call the owner, so you do not call the owner - likely because it is a PREFORCLOSURE assignment - I bet the owner will not be happy about anyone photographing the house he/she is about to lose, let alone talk to the person valuing it for the bank. Take a fast photo and gtf out of there.

Or call the owner and get them angry and standing on the front porch waiting for you to show up and take a photo while also betraying your client - seems like a no-brainer choice ( sarcasm )

I call the owner on a conventional driveby when the client gives the owner phone number.
 
If an engagement letter states “Do not do something”, it’s probably a good idea not to do it. This is not something Henry Harrison covered in any of his books, but it’s been referenced before in other literature. Ie. Do not pass go. No trespassing. See Spot run. Go dog go. I like green eggs and ham.
