Copy of appraisal

Web I yield to you in respect to USPAP you possess more skills to reference USPAP than I, but I’m a simple business person. If a property owner who is seeking a copy of an appraisal contacted me I would help this person in respect to USPAP. I would direct them to an individual that could help them. I would not just state USPAP regulations and say good-bye.

I had this scenario happen to me two weeks ago, an attorney ask me for a copy of his appraisal, a two year old appraisal. The client on the report does not exists, two banks merged with a new name. I see this attorney who requested the copy weekly in the court house. I contacted the new-name bank and told them there applicant/client of the previously name bank is requesting a copy of an appraisal. I sent the appraisal in a PDF file to the new-name bank and then the new-name bank sent it to him. If you believe I violated USPAP, my name appears above; you have my permission to send this thread to board of your choice.

I suggest it is entirely much easier for everyone involved if appraisers stop being so simple and consider advising borrowers, in writing, that it is the borrower's responsibility to obtain a copy from their money source immediately after the event of the original appraisal takes place. Versus somehow becoming the appraiser's problem years later because the borrower procrastinated and failed to obtain one when one was easily available to them. Personally, I impress borrowers with this by asking them to sign a document that sorta states that, only a bit more tactfully. So honestly, which appraiser is more on top of things and is providing better customer service? The one that gets the customer to acknowledge a heads up about all this in writing at the time, or the one that places themselves in a position of having to violate the Ethics Rule later by never making sure the borrowers are informed at the time of the appraiser's inspection that borrowers have responsibilities too?

I am not in business to be the fall back position for every procrastinator I might come across. They get a copy of this document of mine I had them sign when they come back to me later due to their own procrastination or lack of organization and it is placing me in an unmanagable position. Perhaps it is because I opted to not be simple and deal with this crap head on a very long time ago. ;)

This example does not support your original claim at all. In this example, you sought and received permission from your original client.

It's not uncommon for clients to no longer exist these days. Nonetheless, it is absolutely incorrect to state that because the bank who is/was your client has merged with another bank under a new name, that your client no longer exists.

Our MO Board is no help to appraisers. They are there to "protect the public" and to keep them safe from wild appraisers. It has been an education to read all of the replies. I hope you don't scold me again for asking questions on this forum. Thanks again to all.

Mr. Coffey,

I don't believe advising people to call their own board on some of these topics, versus asking the forum, is scolding anybody. It's not the forum that revokes or suspends your license, or hits you with fines and forced CE.

If your board in that state will not assist an appraiser licensed in that state with such a question then it is very far past time every appraiser in that state revolts and demand the governor replaces all the staff and reorganizes that board with a new mission statement. Your licensing fees, I am sure, is not just a bunch of funny money that only buys you trouble with your board and no guidance. It sounds like their lack of service to the appraisers is shameful.

The boards/government must have more time in Oregon (and be willing to give binding opinions) than many other state boards. The question/response may require a locational adjustment. Not a critisism, just an observation.
