Deceased owner heirs trying to sell

Hello everyone,

I got a reporting issue just wanted to see how other appraisers report it. The public owner of record is deceased. Three heirs are selling the property. One is the power of attorney. The realtor gave me this information rather than the lender or AMC. Also, no public record data is verifying this other than one of the heirs shares the same last name as the public records owner. All three heirs are on the purchase contract. How do I report this? "Is the property seller the owner of public record" - No? Any thoughts would help.

Have you contacted Title Company? More effort, go to county records.
 
Title Co may not know yet. Look up the obituary that may have the list of heirs. Lack of info is not uncommon for estate transactions. OR, it may be a pre-death transfer, the realtor likely knows more than he is telling.
 
I doubt anyone cares. State the ownership on the tax card as "heirs of the estate of XX XXXX"

Then state that the heirs are selling the property after the owner's death. Discuss this under the contract.
 
Remember that it will be the Title Company that makes the final determination whether to insure based on verifying that the sellers on the K have the legal right to sell. Your job is just to "Report the facts, Ma'am" ;)
 
If the trustee has filed in court and accepted by judge- then the trustee is acting upon behalf of the deceased technically as a proxy for the actual (dead) seller. I was trustee of the estate of a cousin. But I signed an administrative Deed to sell the property, and the deed states the owner as "XXXX Shields Accounting Services" seller and the buyer as "XXXXX & XXXXX XXXXXX" . I was merely a proxy signature for the deceased.
 
Just report the facts. Seller is not the owner of public record.
Check docs from Title that Seller is owner of property.
Appraisers should easily call Title company for information. They will help you if use Fernando charm.
