I am also dealing with a garage converted to a master bedroom suite. The new bedroom is finished better than the original house and has a separate electrical heating units. There is an additional 1 car garage on the property and the dwelling has 4 additional small lots that go with the home (separate deeds and legals). The conversion of the master suite caused the original 2nd bedroom to become a walk through den area. Sounds like fun yes?
Mike: I guess because I know its not to code and if the buyers dicided they did want to use it as a bedroom...and something happened... I could (and would) be named in a law suit "why didnt you call for it to be removed if you knew it was not up to code and you knew it could be used as a bedroom".
Maybe I'm overthinking it and just paranoid.

My gut was to just leave it alone but I wanted some feedback from others with similar experiences, thats all.
HUD convention to overlook permits poses a huge measure of liability on the appraiser, and there is no FHA shield regardless that you might disclose that the configuration was assigned value as living space regardless of the permit status. Per the SoCal HUD office an appraiser who fails to determine market reaction to an area that appears to be built in workmanlike manner can result in immediate suspension from the approved list...
