With NAR war chest, they could have fought this all the way to the Supreme Court.
Instead, they pay a hefty penalty and confusing way of paying agents. Good for investors who have cash and need less hand holding in real estate transactions.
I don't think it is that. It was buyer or seller not wanting to pay the other's commission. Kinda like APPRAISAL/AMC
 
Seller signed the listing agreement and has to honor it.
If Seller has beef with listing agent, it's between them. I seen such squablling and would cause trouble for the buyer

Why the new disclosures after huge settlement that NAR paid.

NAR did not want to fight it.

The riff started between buyers and sellers. Not NAR.
 
Hence new disclosures to buyers and sellers.
