Highest and Best Use: The highest and best use of the subject is the use that has the greatest economic return to the land. It considers the four tests of: physically possible, legally permissible, economically feasible and maximally productive.

The subject is located in an area of older family farms. Some farms are raising cash crops, some are fallow. There is a demand for homes on larger parcels of land. The subject has 56 acres and is divided by the roadway and is considered to be suitable for subdivision. However, the property is enrolled in the Act 319 program and would need to pay many years of back tax incentives in order to be cleared for subdivision. Considering the additional costs to release the subject from the Act 319 program, and the current market conditions, interim use as a family farm is considered to be the highest and best use until market appreciation overcomes the fees necessary to remove the subject property from the Act 319 program.
