HUD Roster removal

rcvd a letter from HUD proposing removal from roster based on 3 reviews...never ever had a letter like this from HUD, state, etc..there are some errors but nothing significant..the reviews are very negative but the reviews also have significant errors and statements which are totally inaccurate which i will be pointing out in a rebuttal along with conceding to some of my own errors...any suggestions on appealing this....or is it a waste of time...i have been thinking about avoiding FHA work due to the liability, this may be a good time but i still dont want to be removed...that cant look good...any suggestions or anyone with experience with this

2. FHA Administrative Appraiser Roster Sanctions

A. Removal or Removal with Education
[FONT=&quot]Deficiencies involving improper valuation, failure to report repairs, fraud, failure to comply with prior FHA actions and other serious omissions, including a history of prior actions or sanctions, may result in removal, with or without remedial education, from the FHA Appraiser Roster for a period of up to 12 months. Removal with or without education may be appealed by the appraiser. The Department will notify the state licensing or certification agency in writing when an appraiser has received a final notice of removal from the FHA Appraiser Roster.

[/FONT]B. Limited Denial of Participation (LDP)
A LDP prohibits the appraiser from performing appraisals used as collateral for FHA insured mortgages and is subject to appeal. Generally no longer than 12 months in length, LDPs are typically restricted to specific HUD programs (such as FHA) and may or may not be national in scope. C. Debarment
Debarment can remove the appraiser from the FHA Appraiser Roster for an indefinite period depending upon the level of seriousness of the appraiser’s conduct or non compliance with FHA performance standards and is subject to appeal.

3. Civil Sanctions
Pursuant to 24 CFR §28 and §30.36, appraisers may be liable for civil penalties and assessments for each violation. Under 24 CFR §28, the Department’s Office of General Counsel processes the complaint. Civil money penalties under 24 CFR §30.36 are imposed by the Department’s Assistant Secretary for Housing. Civil sanctions are subject to appeal.

4. Criminal Sanctions
If an appraiser’s non-compliant action is so egregious as to violate criminal law, HUD’s Office of General Counsel or Office of Inspector General will refer the case to the Attorney General at the U. S. Department of Justice. All criminal sanctions are subject to appeal.

proposed....i have 20 days to respond in writing...what bothers me is that i have never had a letter from them for any violations in the past...not sure how i should be looking at this...im pretty sure i can make a solid case for remaining on the roster but i really have no idea...maybe they rubber stamp these appeals

Opinion: Whenever a client, or regulatory agency, or govt. agency offers an opportunity to correct possibly incompetent or, at a minimum, misleading reviews - TAKE IT.

Respond professionally NOT emotionally (certainly understandable at this point).

With 20 days to respond - DO NOT WAIT until the last minute and DO NOT make an error in judgement borne out of emotional response to the notice received.

Take your time, rebut EACH allegation in each review ONE AT A TIME with verifiable fact and/or clarification. Be certain to "get your ducks in line" within 10 days - then..................

let your replies ...sit for 48 hours .......and then review them line by line to ensure a professional response.

YOU MAY wish to consult a trusted Mentor/Advisor with both considerable FHA and USPAP expertise to review BOTH the review allegations and your written responses - WELL IN ADVANCE of the deadline.

Hi Eric,

You absolutely want to appeal the sanction. You do not want to be removed from the panel if at all possible.

Send your appeal as soon as possible and be very clear in your response. Do not review the reviewer. Make sure to appeal the deficiencies in the review for each report.
IF
they sent 3 reviews, send 3 appeals plus a 4th which includes all 3 rebuttals on one appeal. Otherwise, just send the single appeal detailing each report and your rebuttal just like they did in the review.

Good advice.

As an old (at the time in the mid-1980s, he received the MAI designation at--reputedly--the most advanced age of anyone who had ever earned the MAI)
appraiser once told me: "I never met an appraiser who thought that he was wrong!"
