HUD window height requirements

I cannot find the height measurements from the floor to the sill for a bedroom in the new 4000.1. Does anyone know where specifically it is? I have always used 44" as the maximum height but the client states that is only for below grade units and I do not believe that is correct but I cannot find it and calling is fruitless to HUD. The unit I am appraising is a one bedroom condo with the window 58" floor to sill and they are contesting this.

HUD has no window height and never has. The client is correct just move on and be done :) LOL

As far as I remember. HUD has requirements such as the above for new construction and major rehab of HUD projects. Nothing in the 4000.1. If there were such regs. A very large percentage of existing homes (especially older homes) would not qualify for FHA financing. Local building codes generally have such requirements. But I have never seen any that are retroactive,
 
In California almost no older home would go FHA based on your reading of window heights. BUT they do qualify everyday. New homes under new codes do have different code.
 
Thousands of homes and condos in this area do not conform to the new building codes re: window height requirements. They get FHA mortgages everyday.

Your reading of the code is correct, 44" from the floor (also 1,000 sq.inch minimum area and 20" minimum width clearance) but building codes are not retroactive. Your client is correct.
 
I've never seen a specific number. The idea is that it should be low enough (and the window large enough) so that an average person can escape out the window.

There used to be a requirement in 4150.2 3-3 B for basement bedrooms or basement apartments which included a 44” window height and other size requirements. If the window height/size were not met, the bedroom area could not be counted as habitable living area. Those requirements were superseded when 4000.1 was published and are no longer applicable.

the issue is more of a fire escape problem, can you get you as* out of that window. but even then it's just a window.
