I replied 'that the HVCC was retired in October 2010 and is no longer in effect. Also, neither it nor its replacement (the Appraiser Independence Requirements from Dodd/Frank) pertain to the appraiser complying with anything. Rather, the client is the one that is required to be in compliance.'

And they replied that they would still like to have the comment placed within the report.

The lender should note that HVCC is no longer in effect (as of October 2010) and it never required the appraisers to do anything, but it did require the appraiser's client to be in compliance with HVCC.
