I'm sure we do have some laws on the books which parallel the meaning and intent of some of the laws of other nations. That doesn't mean that those other nations wrote our laws.

Honestly, there’s a real argument that what TAF is doing could be unconstitutional under Article I. And it’s not just TAF—this kind of thing is happening more and more, where private groups are basically acting like regulators, and the public is getting stuck with the consequences. That’s classic regulatory capture.


Article I says only Congress can make laws. Yes, Congress can delegate some of that power to federal agencies, but they’re supposed to give clear guidance—what the courts call an “intelligible principle” (from J.W. Hampton Jr. & Co. v. United States). The problem is, TAF isn’t a government agency. It’s a private organization with no real public oversight, and yet it sets standards (like USPAP) that appraisers across the country are forced to follow.


That’s a huge deal. These aren’t just “suggestions”—they’re treated like law. And the people making these decisions? Not elected, not accountable, and in some cases, they may have conflicts of interest. So yeah, that could very well cross the constitutional line. This is exactly the kind of unchecked power the founders were trying to prevent.

Attorneys wrote it because without a SOW the appraiser is like a boat with no rudder and has no defined job description. Before USPAP the users and clients told the appraisers what they needed the appraisal for.

No difference today the users give the appraiser an engagement letter. Then the appraiser determines if he can create a SOW that will fit the users need's while doing so within the confines of USPAP. It's State Licences and USPAP that created the final authority on SOW prior to licenses there was no USPAP and there ya go blame licensing.
 
The reason States licenses appraisers and not Federal licensed is because States have their own laws.

If they had made licenses uniformly across all States there would have been Constitutional issues that would have thrown so much sand in the gears we could still be fighting in the Court's.
 
License renewal fees for states is a source of revenue for them - consider the many professional and trade licenses in many categories,
