Illegal ADU on an FHA order

You actually gave zoning the location of the property. Wow.
Sometimes I even call the town to see if water or sewer are available for a property. Lenders want to know and how much it costs. How do you verify issues? Not everything is online. Back in the old days appraisers frequently had to go to town hall to speak with assessors, zoning officers etc. How exactly would you verify data not available on the internet.

Made many a trip to town halls, assessor's office etc. But have never found it necessary to provide information about the characteristics of a property to get the info I need
 
Dealing w/a duplex now that was grandfathered when they changed to SF zoning, but cannot be rebuilt without obtaining a variance from the city. I'm sure that's going to twist some heads off, but thankfully they can't shoot the messenger.

On second thought - I guess they can shoot the messenger if they can track me down...
Yes, I've had a house in a mall parking lot and a mobile home behind a Dollar Store where the zoning changed and the city wanted them gone. The structures could not be rebuilt as residential if they burned down.
 
did you ask the client if you could discuss their confidential appraisal with zoning people. that's like an attorney discussing private info with the other side. couldn't have done it without the address.
USPAP say only if subpoenaed by a legal entity. were you. i the owner, and i'm asking the lender why you give out this private info, cause it was not public. and now you created a problem, when there wasn't any.
I am asking for public information on the property. Not discussing the appraisal.
 
Maybe, maybe not. If the fact that the property had an illegal ADU was not available anywhere else. You might find yourself in a rather "sticky" legal situation.
The fact it had an ADU was available for anyone that could use the internet and get on Zillow or Redfin. Zoning information is available to the public on the City's website.

None of this matters any more cause the order was cancelled today.
they cancelled you. it still might be going to another appraiser. it's a business decision, and even here it's 50/50 on what it could be. but if that other appraiser sees it differently, this client might now look at you differently. not saying good or bad, cause i don't know your relationship with this client. if there is a hill to die on, i call the lender and tell them i can't do it cause of some conflict. i throw that porcupine back to the lender to hold. appraising survival class 101.
