Lawsuit Alleges Appraisal Institute Has Given States Fraudulent Test Results For Years

This may be the institute's "Toby the Cat" moment.
 
like i believe any attorney...they are not deceiving...they are not ignorant...they are just plain lazy i cant stop laughing :ROFLMAO:
 
Ignorance of the law or laziness is no excuse for not abiding by it, as individuals are expected to be aware of their responsibilities and take the necessary steps to comply with legal requirements. Try using that excuse when you're brought up on charges by your state appraisal board— it won’t get you very far.
 
The reason I pointed out what the plaintiff's advocate said is not to justify or rationalize the conduct but as a counterpoint to the "malice" and "intent to do harm" elements which are also being implied in the commentary.

The Occam's Razor version is that their due diligence in their reporting was (allegedly) inadequate and they didn't bother to fix the problem despite being informed of it. That is not difficult to believe, nor difficult to understand how that could occur.

Not at all. I just think the response should be commensurate with whatever the offense actually amounts to.

WRT an offense we would normally look at the means, motive and opportunity.
They had the means (nobody is disputing that)​
They had the opportunity (nobody is disputing that)​
So what's the motivation? In what way did they benefit?​

If the allegation is that they acted out of self-interest then what is the extent of the self-interest involved to occasionally report "passing as failing" and at the same time occasionally report "failing as passing"? However often that would have been the case.

Remember, I am not a member and I have nothing to gain or to lose if this controversy blows over without it hurting the org. I am an outside observer, even if all I can see is what makes it into the public realm.

Whether the AI legitimately thrives or starves will have no effect on my personal interests. Other than a fair/reasonable outcome appealing to my sense of right/wrong. As for the pragmatics, I daresay someone taking their USPAP course online or in a live course from an AI-affiliated USPAP Instructor is probably still learning more about the topic than they would from a few of the other providers. And I can say that as someone who was directly competing with them in the marketplace for QE and CE instruction. That being a perspective that not a whole lot of other commenters will be able to claim.
