Lender rejecting loan until non existing title surrendered

For a nominal fee IBTS will verify compliance with the HUD building code and issue documents that will confirm. This is usually enough to get the loan done. It's free if the loan is to be insured by FHA.
 
i have pictures of both the underside of the home, and the data plate, but this site is asking for a url to upload..cannot copy and paste..working on it
 
the frustrating thing is that we have met all FHA requirements, I had the seller do the foundation, septic and water up front..I have sold several mfgrd homes affixed here in the past years...had all of that, with data information ready. Wells tells me it is a requirment that they have added in the past couple years, after being burned on foreclosures where the home has not been properly recorded as surrendered, so the owner could claim it is personal property and keep it.
 
I'm not sure about all of the specifics, but when Michigan went through this process (about same time as MN) they wrote the regs in such a way to provide for situations like this. There's even an option, when the dealer didn't file the C of O and no title was generated, for affidavits to be signed by the owner, former owner, dealer, etc. In some cases, original owners are dead, dealer out of business, etc. so MI allows for the local sheriff to interview the owner, sign some forms, etc.

thank you! I have been working with every state department for two weeks, from the secretary of state, commerce, ag, building code, and more...just to get nowhere..I got Mike Brunners number today off the web, and have actually e mailed his blackberry about an hour ago, thanks! just thought to come over to appraisors forum, as you guys always seem to have knowledge that helps! will get data plate up in a minute..just figured out how to do a url and attachement on this site
 
Fairmont built some homes with a hybrid type of chassis. It's a permanent steel chassis but not the conventional type used in most HUD code homes. From the image you posted, I suspect that is what you have. But that chassis was used with both HUD code (manufactured) and modular homes. So what we really need to see here is a detailed image of the data plate.

The "Perim frame" seems to confirm what I suspected about the chassis. It's the perimeter frame that is designed to be supported at the perimeter of the foundation. But it still doesn't tell us to what code it was built, which will determine if it's manufactured or modular.
