Lender Requesting Copies of MLS Sheets.

I agree with this. I suspected as much.:icon_mrgreen:

I gonna turn CANative into his MLS for distributing copyrighted information in his reports. Where he lives, the board and membership is probably him, his brother and his dad.:rof:
 
People need to understand copyright laws. We don't re-print and re-distribute MLS sheets in our reports because it is against copyright laws. Even though CANative says it is OK for what he is printing and sending in his reports, the fact that it is copyrighted on that sheet makes it against copyright laws to re-print and re-distribute. We can and do dissect the MLS information into our own format (our reports) which is what we pay for use to be able to do. Let the AMCs join the MLS and get their own copies if they want.

Well, when you work for 5 years in the publishing industry and where the president of the company is an IP Lawyer you are bound to pick up not only the basics but, unfortunately, some of the finer points as well. One reason I try to be extremely careful is that all I would have to do is land in court and have the opposing lawyer realize who my old boss was and I would not even be able to plead ignorance :sad:
 
We're not selling the MLS information to our clients. We are providing it as supportive documentation for our value opinion.

Why are you going out of your way to possibly get other appraisers in trouble with their local MLS?
 
At most, the MLS board would tell the appraiser to stop doing this. I guess they could impose a small fine if they were inclined.

I don't freaking care about MLS. I have to pay them just as much as a Realtor member but I use it very infrequently and don't upload things that require maintenance.

If they want the real estate market to keep going (for the benefit of their Realtor members) they can just look the other way on these minor issues.:angry:
 
I called the bluff when I said NO. I do believe some appraisers in the area are providing this information. The MLS board believes it is happening the problem is how do you catch them.
My original question "is the lender/client or AMC required to be USPAP compliant? and this requirement a USPAP violation, if they are?"
What do you think?

I am surprised you do not comprehend what parties USPAP applies to and what parties it does not apply to. As it is only gone over in most all USPAP classes.
 
When all else fails cite USPAP.
 
I see your point, I'm sure someone will be chiming in soon that is an expert on that very issue regarding a USPAP violation.

As far as committing crimes and is doing so a concern relative to appraiser licensing? Have you checked the questions you have to answer when you renew your license lately? Might be something to do with USPAP lines 193, 194, and 225.
