MISSOURI has an AMC Bill!

Finally, Missouri has an AMC regulation bill...YAHOOO!!!! Here is the link if you wish to read it. http://www.house.mo.gov/billtracking/bills101/billpdf/intro/HB1440I.PDF

A few months ago I talked my state rep.(the sponsor of the bill) into introducing something for AMC regulation. The bill he sponsored is one that was passed around early last year but never got off the ground. I think the bill is a great start but it seems week in a few areas.

I think the bill needs more specific language about who is paying the appraisal fees and clearer language about separation of AMC fees and appraisal fees on the HUD Settlement Statement etc.(A recent North Carolina AMC bill states that only lenders can pay for the appraisal report and that AMC's must collect their fee from the lender....which is just awesome).

My state rep says that they are trying to get the Missouri Appraisal Advisory Council to sign off on the bill because there was some language in the bill that they wanted changed. I called and spoke a board member 'David Doering'(an appraiser who owns fee shops all over the state) to see what they didn't like about the bill and it seemed to just be a few clarifications making sure that appraiser's don't have to put up a $250K bond with the state like the AMC's are going to have to. I talked with him about getting the language cleared up on the appraisal fee issue and he was very reluctant to strengthen the bill up at all, for fear that it would never pass. David Doering and my state rep says they are already getting pressure from various groups about the bill.

Personally, I think that the time is right to ask for what we want, but I know the political process can be very difficult.

Call the MAAC or your state rep and voice any concerns you have about the bill right now while we have the chance. David Doering was nice enough but he seemed pretty defensive about the bill and agrued every point I made...I ended up feeling shut out of the whole process (did I miss something, or did MY state rep introduce this bill after I hounded him about it!) He was actually making an arguement for why the lender should not be responsible for the AMC fee or pay the appraiser directly for their services...huh?....isn't that what we want?

If you have isses, call him, other board members, or your state rep.

'Helping' regulate the AMCs will require much time and effort on behalf of the state's appraisers. I am putting in a call today to my state board myself regarding something that came to my attention yesterday. If appraisers sit back and expect the state to do everything they will very likely be disspointed in the results.
