I think they can ask for them. The appraiser will only have what they have not destroyed. I am unaware of any requirement for records to be retained beyond 5 years. And man when this first came to light, if it were me I'd have my shredder working overtime.I haven't looked into it but there has to be some appeal process. Otherwise vindictive prosecutors can just tell you to turn over 40 years of appraisals and their workfiles. 6 years of reports is different than wanting the reports in question. It is a fishing expedition.
