NC Appraisal board complaint

An attorney who is the former head of the NC appraisal board has an office in Cherryville and specializes in defending appraisers. Last name opposite of white.

And he is very often engaged by E&O companies.:icon_idea:
 
To the OP,

Your post is a little confusing. The letter from the Appraisal Board should specifically explain the complaint and the one making the complaint. It should also state they want a copy of your full work file and a letter from you addressing the specific complaint within 30 days of receiving it. Then it will be assigned to an investigator which will get in to it more thoroughly, and sure if they find errors they are going to let you know. And thats the scary part is, the punishment...whatever that may be.

I'm not sure if you have ever met Roberta (legal counsel) or anyone else at the Appraisal Board. My impression of them is they are all very approachable. They are not out to get us. They are making sure we are doing our jobs correctly.

Yes, as you can tell I've been there done that. AND as long as we are dealing with the public, giving them an opinion of the value of their precious homes, there are going to be complaints.

$10K difference sounds like you guys were BOTH dead on. I don't see what the problem is.
 
It sounds like # 2 below. The board say her report while investigating the complaint against the other appraiser. The board then decides they want her (the OP) to speak with them about HER report.

BOARD COMPLAINTS


The North Carolina Appraisal Board has the statutory authority to investigate a complaint against an appraiser upon the receipt of a written complaint against the appraiser or upon its own motion (a Board complaint).

In some instances, staff may want to ask the Board to open a complaint on appraisal reports looked at during the routine course of business, or may obtain information regarding an appraiser that the staff believes warrants further investigation.

Some of those instances are:

1. When looking at a sample appraisal report as part of an application to upgrade or an audit, staff may see some issues in the report.

2. In investigating a complaint against an appraiser, staff may receive a copy of an appraisal report performed by another appraiser on the same or another property that shows some areas of concern.

3. Staff may receive information regarding the character of an appraiser, such as the loss of another occupational license or a criminal conviction.

The state is required to investigate every complaint, no matter how it got to them or how stupid it is.
In talking to some of the investigators in Colorado, they have had complaints against appraisers because the appraiser did not take off their shoes.
The investigators at the time of the "letter" generally have not looked at the report. That is why they want the workfile and the report. They then review your report and write their report. They don't worry about the value just how you got there (USPAP 2-2b viii). (in Colorado, depending on the findings - seriousness - of the violations it will be handled by the "staff" or the actual board.)
I can tell you a few things to do
- give them what the want workfile and reports
- be approachable
- be polite
- make the time for the appointments (phone/person)
- listen to what they say (most boards goal is not to take the license but to make you a better appraiser)

- fabricate data
- pull data and put in your work file to "help" your case
- blow them off.

Call an attorney that deals on a regular basis with the board in defending appraisers
an administrative law specialist is the ticket but they are not cheap.

I had a complaint with the NC board. The fool that made the complaint included 3 pages of BS which attempted to explain why my value was too low.

I sent in my workfile and a lengthy response to the complaint letter which addressed each and every point, along with proof, data, etc. It doesn't sound like you have anything substantial to answer at this point.

I would agree with other posters that say to call Mel. Mel will give you good advice.
