every morning i wake up and thank you Jesus for letting me see the light 5 years ago and not appraising for any mortgage broker since then..actually maybe closer to 7 since I first the last MB. No complaints that i know of from my bank and estate people.

I don't thank Jesus, but I'm with you. Not having done any Broker work for many years lets me sleep real well. I'm just waiting for Skippy to follow the brokers down the path to Hell.

Home Buyer Sues Buyer's Agent Over Lack of Disclosure

A Carlsbad California homeowner is suing her real estate agent, a buyer's agent in her recent home purchase, over a purported failure to disclose information on lower-priced homes in the same neighborhood.

This could be interesting, given the fiduciary relationship inherent in a buyer/buyer's agent relationship.

Ya, think?! They sure do make seem so in those slick TV shows.

If they win this case, this will send shivers to the Realtors, and it should. It seems that what rolled down hill is piling up to the top of that Hill.

Sounds like a quote we should pass along to every bank, lawmaker, and borrower we meet, doesn't it? lol
 
I'm big on personal responsibility and despise the victim mentality; however, in this case I think the buyer's agent screwed up. As the husband of the agent for the lower priced house sais:
“We have seen so much misrepresentation over the last five years,” he said. “So I appreciate where these buyers might be coming from: ‘I’m a lowly consumer, you’re certified by the state of California, you didn’t do X, you didn’t do Y, and I got hurt.’ ”
A buyer's agent is not selling a house, they are assisting someone in a purchase decision. It might be that notification of some properties in a neighborhood are simple one line lists, but one should not have an individual put in an offer on a house without letting them know all the options. The buyer should decide what they don't want. If they have criteria, get it in writing. Large amounts of money are involved, document everything.
 
I've known some 'buyers agents' that show ONLY the highest priced listings to their buyer 'clients', intentionally misleading them.
