Probate Referee as appraiser

a bit of an update...

After asking the trustee why the comps were a year old (the same ones used back in July), after calming-down, said that she would check with the appraiser. I had shared that I think I found 4 that could serve as comps, and if so, the reason for using dated ones didn't make any sense...

Today the trustee contacted me stating that she spoke with the appraiser. I didn't get a good answer as to why those old comps were used. I was asked to share with the appraiser the "comps" I found though! To me this seems somehwhat absurd. I already put something together to fax the guy, but this just seems too strange...

Just thought I would share!

In your shoes, I would avoid providing specific appraisal-related information to the appraiser/referee. That is the appraiser's job, not yours. Let the referee hang himself, if the quality of his work is substandard, and petition the court to order corrective action.
 
Erick, that thought crossed my mind alright... Petitioning the court, getting a lawyer engaged... really hope to avoid that.

I've been making inroads with them (trustee & husband), getting little wins here and there in order to get an equitable distribution. Maybe the appraiser will accept these, like he did my lot size calculation (I still find this odd!)...

A very kind forumite gave me a link to the USPAP. I got fairly faimliar with this info, and it appears that there are several short-comings in his reports, for which I mentioned earlier. Are all appraisers to be held accountable to these Rules and Standards? If there are exceptions, it would be nice to know...

State licensed and certified appraisers are subject to USPAP. Here's a link to the state of California licensing board (OREA). You can search for the referee's name at this web page:

http://www.orea.ca.gov/html/lic_appraisers.asp


If you find the referee's name on the OREA website, post the license level for us (it will be a two-letter code in the "lic. lev." box). It's public information.

For example, if you search for Cynthia Hamilton, you'll see that her lic. lev. is AL. I chose Cynthia's name, because she seems to have an obsession with bears. LOL.

To make sure I did it right, I did try Cynthia's, and got a hit alright. I do seem to recall a dancing bear avatar around here! I suppose that was her...

So... by him not being on the OREA website, he's not state licensed? On his professional summary page, it states: California Real Estate Association and California Probabe Referees Association.

Hmm, if I'm not mistaken, the CREA was the predecessor of the California Association of Realtors. If you would, send me a Private Message via the Forum with a link to this referee's website, if he has one. Memberships in certain associations doesn't necessarily make this referee a qualified real estate appraiser.
