So I called the department in charge of fire code compliance. (718-999-2541)
According to an inspector I spoke to. They can have a gate on the first floor in the bedroom without violating any fire or building code, but they strongly recommend against it.
I guess this answers all of our questions.

Thanks everyone for your help.

That's about the same answer I got several years ago. If it blocks a fire escape it needs a safety latch others wise no latch is needed in a residential property. I generally include a statement that the appraiser was unable to verify any building/fire codes regulate gates on 1-4 family dwellings.

A high rise Coop/Condo is a a different animal, the fire dept appears them to be considered a Commercial property.

Thanks NYCapp.. I've never been able to get a straight answer about this!
