Quickie question (as my granddaughter would say)

Under the new changes in USPAP, I think you would be and are, correct. I think it is a stupid change in USPAP but it is what it is. I really hadn't thought about that aspect of it.

As a website noted, "In simple terms, one unique client assignment = one distinct inspection and analysis."
It's only a USPAP issue to the extent that it is part of the agreed upon SOW as the F/F forms state that the effective date is also the date of inspection. If you sign the certification you are attesting to this.
The USPAP change you noted clarifies that prior personal inspections are not to be misrepresented as being a contemporaneous personal inspection in a future assignment.
 
Hired by AMC to do appraisal for an unknown lender for refinance. Homeowner wants to go to another lender and use the same appraisal. But the original lender will not respond. I know I cannot release it but if the original lender refuses to respond, does the owner have any option to use the appraisal?
What is an, “unknown lender”? The AMC is not the client. The lender is. In your appraisal, you state the client.

I will assume that you did a poor job in your post and you actually know the lender. So, the buyer is going to a different lender. The new lender can use the report. You do not “release” anything (up to the two lenders) . However, they cannot ask you to change anything, using the report as is.

If they are asking you to change something, refuse. But, you look at the letter of engagement from fthe appraisal. If they don’t specifically say you cannot do another appraisal of the property, you do not need their permission to do another appraisal. Read the last point. You can never, EVER “transfer” an appraisal, even with “permission”. The change of client means a new appraisal and appraisal file.

No. And this isn't your problem. The original client can transfer the appraisal report to a new lender. That's a process that doesn't involve the appraiser. However... original lender is not required to transfer the appraisal report. If they do, you are still bound by the same confidentiality rules. Your original client is the client for that assignment forever. You can't deliver the report to the new client. You can't change the report at the request of the new client. You can, accept a new assignment for the same property from the new lender and charge the fee you think is appropriate for the work required.
