Is that your example for the clear AIR violation of the day? :) "Requiring" is not the same as inquiring.

Perhaps you could include it and charge a non-contingent contingent fee :)

Do you think that the D-F comp alternative exception gives Lenders the right to send over less comparable sales for an ROV simply because of their higher sale price to try to get the appraiser to raise the Market Value?

It's a simple yes or no.
 
My e-mail reply would toast the hairs on your nether regions if you were the "requestor/requiror"... in a congenial way...:blowingup:In no uncertain terms did I express my displeasure at someone not responsible for my signature exerting undue influence on my report. I offered to include it this time at no charge, but my commentary would 100% reflect my sentiments and future such inane requests would be $75 per "less reasonable" comps. I'm tempted to just ditch the client but having talked to one of their employees think they may be a legitimate decent long term client. Current BS aside.

That is a simple question, and the answer is clearly, no, that is not allowed.

What is allowed is for a buyer/seller/agent to ask the lender to forward sales that the buyer/seller/agent legitimately deems appropriate, along with a request for the appraiser to consider them. Simply forwarding such a request does not (by federal law) in and of itself constitute pressure.
 
Ignore Resguy. He can't separate C and Q ratings, one of the most simple of appraisal concepts.

Ahhhh... ok.
So you admit it's wrong if you, the lender does it because that would be value pressure..but if the lender forwards value pressure to the appraiser, it magically ceases to be value pressure.

Oh yeah, I'm sure that was the intent of D-F :rof: :rof: :rof:

Serious question; What does legitimately deem appropriate mean? And by what process are those sales given that status?

Ok, then, perhaps you can explain it. If asking one to address sales is always pressure, then why does the DF AIR provision specifically allow it? The biggest error in your posts is the presumption of pressure. If that presumption were accurate, the DF would not allow what it allows.

What it allows is questioning of the appraiser. What it does not allow is pressuring the appraiser. Unfortunately, some appraisers cannot (or will not) see/appreciate the difference.

So I pass along an ROV. The apppaiser provides a good clear exlanation of why the sales submitted are not relevant. Life goes on. Where is the pressure? RG just does. not want to have to reply to the kind of inquiries that DF specifically allows, so he just yells “PRESSURE”. Maybe he is just a big Billy Joel fan. I dunno.
