Sellers Agent Making Threats To Sue Me

You've already had many excellent responses.

#1: Whether you're a Realtor or not, write a very complete transcription including ALL vulgarities and ** them with enough letters included so all would not have to guess just what the words were. FILE A COMPLAINT WITH YOUR LOCAL BOARD OF REALTORS!!!! All Boards have a grievance committee. This is so bad I would also cc to your State Realtors Association and the National.

#2: Review your file and appraisal. Jot notes or write up the reasons for your comp choices and why you didn't choose the ones you didn't use. Put the file in good order and keep it handy and safe.

#3: DO NOT let him get to you. Call an attorney or your local police department and file a harrassment complaint. IMMEDIATELY. If he calls you again, calmly give him the name and phone number of your attorney or the officer that took your complaint or the prosecuting attorney. The primary necessity here is to get this on record, NOW.

DO NOT be afraid. If you are, and I can understand this, DO NOT UNDER ANY CIRCUMSTANCES LET HIM KNOW.

Stand tall, keep your chin up. The ONLY way he can hurt you is if you do nothing and cower.

This man is a nasty BULLY and there are plenty of others out there that know it too. If you let him get away with this, he will get worse. Maybe not with you right now but, he will get worse. He can and will try to slander you and I'll bet he's done it to others. Very few will believe him but some, being afraid of him, will do as he bids.

If you ever need to talk to someone who's been there, contact me via my email and I'll call you or you call me. Either way, if you are feeling down and/or feeling your strength faulter, CALL ME. DO NOT discuss this with anyone else except your attorney, the police or the prosecuting attorney (or very trusted friends outside of the business or outside of your area). RESIST that impulse. If anyone else asks you about it, just say he was extremely nasty to you and you cannot discuss it due to pending charges. Believe me, if you do this, the respect for you will soar and he goes down the tubes. Other people that he's harmed will come out of their closets and either openly or carefully and fearfully support you.

I'm mentally sending you strength and determination! Don't let him get away with this. If you do nothing, he can harm you. Not as much as he thinks but, he can. When you stand up to him, most will admire you, respect you and back you up. Those that don't are peons and are not worth a second thought.

Inner strength is power. Stay angry with calm, logical, focused determination. DO NOT LET HIM GET AWAY WITH THIS.
 
Like the gist of most of the posts said, if you really believe you did a competent, professional job, don't lose any sleep over some moron with a big ego. Short story, back in 1988-89 (last time the "values" skyrocketed here - I was only appraising two or three years), we had about 20 appraisers working in an office I associate with. Had a broker, big shot flim-flam artist in "not so prime" areas, sold a ton of properties. Appraiser in the office cut a value on a property which had been listed for $18,900 and this broker "sold" for $27,500. Broker told the appraiser he was going to get the office taken off the "approved" list of a major local bank who we did a lot of work for. We laughed at it. Guess what? We WERE taken off their list, never got any more work. We were talking about pursuing it but didn't. ANYWAY, we survived without that client (for lack of a better word), hey its 13 or 14 years later, well, that "broker" is one step from being indicted for fraud, flipping and has a couple million dollars of judgments against him. He owned a bunch of properties, he doesn't own them anymore and I heard his "partners" are all ratting him out. Sometimes it takes longer than one would like BUT, what goes around usually does come around. :twisted:

Got any friends who are lawyers? Get one to write a letter to this as#h#le. I bet he'll shut up. If not, sue him. You can sue anyone for anything anymore. Take advantage of the system like everyone else does. HE IS IN THE WRONG; NOT YOU.
 
Sorry to hear about your troubles. I have nothing better to offer than my sympathies. Hey, tell us the guy's email and we can let him have it! (just joking).

Try and let some time go by before taking retaliatory measures. Most of the time hot heads will threaten you and then they calm down and go away. More than likely he is upset because he knows you are right.

Wow! Have you gotten some great advice.

Add my good vibes being sent through the "force" right now, and everytime you think about him, picture him as a gorilla. He obviously was one in his last incarnation. :D
 
Thank you all so much for your advice and good wishes. I've been trying to figure out where the "tweny grand" figure he was going to spend to blackball me came from. I thought it was such an odd thing to say.

He said (screamed, yelled) that other deals depended on this one going through, well there are only 15 homes (currently built) in this newer subdivision and two of them are listings. I think that he wanted me to set the stage for the higher values with this first appraisal. Now that the first deal fell through, those others will probably also fall through.

One home on the same street which is a new home like the subject, sold 10 months ago for $183,000. It has 686 less square feet (which I know is a lot but there was nothing else to choose) and has inferior upgrades but the difference between the contract price on his deal, and the prior sale (the $183,00 sale) is $133,000!

So I guess when you add up the commissions on the home I appraised and the others he may have closed, my guess is that it's "twenty grand" worth.

Thanks again for your advice, I do feel much better.
