The idiot l.o. had the audacity to actually say to the judge, "if I had to pay the appraiser for every appraisal for a loan that I couldn't close, I'd be out of business".

My advice for you - go for it and have fun!

Mr. Boyd: My company just experienced a loss when a commercial client reversed his $2,000 credit card charge because he said he never received the narrative report, that the secretary mailed to him without return receit (US Mail). Surprisingly the credit card company upheld his plea when my company had no record of mailing the completed report. Do you think this might be a case for small claims court?

Hmmmm. Not sure. It might be a case of fraud. Logic: If the appraiser has a dated copy of the report and SAYS that he mailed the original, why would a judge rule in favor the the client? If he lost in small claims court he could appeal in Superior court and then the client would have to lie if, in fact, he did receive it, resluting in possible perjury. If the fee was large enough (fee plus penalties) I think I would talk to an attorney.
 
I had a similar experience. The l.o. actually quit the company as opposed to being forced to pay for the appraisal by the broker. He apparently had several of these types of things going on. The broker then tried to avoid me until the sheriff served the papers. At that time, he declared he didn't have time for court and "how much do I owe you".
My lesson was not to extend credit to people I hadn't worked with before.
