Are you telling me the intent of AMC legislation was that they would also be appraisal firms? do you realize how idiotic that sounds?

I’ve cut and pasted passages from USPAP, DF, and state laws. I just state what is written. You guys are the ones who want to argue that that’s not what it says.

But you guys and your buddies at revaa should definitely be thankful that most appraisal boards are feckless. And the ones that aren’t get threatened with lawsuits.

yet the boards usual suspects Will come on and say that meets the Webster’s dictionary definition of independent :rof:

There's an internal paper trail for everything a lender or an AMC does. Who did what. Even if you want to say they destroy evidence there's a paper trail and a pattern of conduct for that, too. All it takes is one disgruntled employee. It doesn't even have to be the appraiser.

We've been over this.

"Appraiser independence" is a term which is defined by regulation. That definition includes several explicit elements while at the same time excluding others which would detract from the original intent. Like your quaint notion that lenders are somehow required to only use appraisals prepared by fee appraisers.

But hey, if you and others appraisers wanted to spend your time and energy complaining that lenders are violating some regulatory prohibition against employing staff appraisers (and reviewers) and using their workproducts in mortgage lending decisions then I encourage you to go for it. I'm certainly not trying to talk you out of it. TBH I would rather see you prevail in that argument than fail.

You and I can't read minds and we have no idea what their intent was but since the largest AMCs in 2012 were all controlled as subsidiary of the biggest banks my assumption is they may have directed the corrupt politician's to allow them to keep or add staff appraisers as needed.

Finally no matter what their intent was it's now a Federal Law that passed and is implemented by our Congress.
