Testifying Againist Appraiser - What Should I Expect ?

Unless they're supoenaed, don't bring your work files. I was given this advice when I testified against a crooked contractor. Make notes and prepare but leave your work file at the office unless, like I said, you have no choice. You probably already know this but I thought I'd offer what I could.

Yes, I had a bad experience with work files in divorce court once and learned my lession. When opposing attorney saw work file, he requested judge to order me to provide a complete copy. Hand written notes I made when initially talking to client read "two appraisals ?" - meaning was opposing side also getting an appraisal done ? Well, by the time I got to court months later, attorney tried to make it seem that I had written two reports - one to show the court and a "real" one for my clients eyes only. Being rattled under cross-examination, I couldn't recall what the note meant . I'm wiser now and don't get rattled by attorneys anymore.

In this case I imagine they will want to see proof that comps used by
other appraiser were bogus, also report was filled with factual errors, etc.
 
You were hired to review previous report. You did so and you have your conclusions which hopefully are based on solid documentation and therefore solid responsible conclusions. So what's the problem? You were NOT hired to judge anybody. You were hired to SUPPORT YOUR CONCLUSIONS AND OPINONS. Just do the job you were hired to do professionally and without off-the-wall-conclusions...just the facts 'ma'am. Funny, it always seems to work best. Don't be baited. Don't judge. Judge give 'um the facts. Even the OJ jury could have gotten to the right answer if they had been given JUST the facts. Good luck. Paulette in Tx, rotts rule and go w... yeah' it's a Shih tzus too.

I imagine that you can bring the proof without opening up your work file. Bottom line....your work file is YOUR property until it is supoenaed.....Then it becomes "discovery" which is shared by all parties. Hopefully the State folks will help you out....
