This VA appraisal I'm reviewing is one of the worst I've read. Is there any way I can report this to the VA?

State Boards make USPAP declensions not reviewers as we are not USPAP Experts
Think I'll respectfully disagree with you here--if WE are not the experts on USPAP, who is? Reviewers? It is a fair point how far we want to delve into calling out a report's deficiencies, but it seems USPAP is so short that if we cannot be expert in it, how are we writing compliant reports?
 
Also, "that alone shows you the appraisal is wrong" is a foolish statement.
No it's not. The home was listed on the MLS. It was a typical sale with typical marketing time. There's nothing wrong with starting your analysis broadly and then going specific. Sometimes you are proven wrong. Most of the time not. Either way I'm finding the most similar comps and adjusting them to reflect the effective date.

OK. So put it in you complaint the the State Board. LOL. I don’t think so.
 
Yes, typical review assignment. I do a bunch of these and I understand that I have to essentially provide an appraisal of my own. Of all the review assignments I've done (I enjoy them for some reason), this is in the top 3 worst appraisals. It needs to be known how bad this report is.



GREAT IDEA!!!! This i why I post here. I've always had the thought in my head that because USPAP is so broad, I couldn't really reference it in regards to bad appraisal analysis. I usually just say something like, "It is strongly emphasized that the appraisal quality is below average and the analysis is unreasonable." before detailing all of the issues with the report and adding support for my disagreements. I'll definitely add USPAP references. I've never had an appraisal omit the 3-year sale history, so that's an easy start.
You get way too personal on these reviews and I have reviewed some horrible appraisals but I keep my analysis professional.

I would never make a statement like "the appraisal quality is below average and the analysis is unreasonable." We are supposed to demonstrate in the review step by step what, if anything, is deficient about the appraisal and analysis. The client can decide for themselves subjectively how bad they think the OA is.

The above is the only clear USPAP violation I see from your list.

I would not in a review accuse the OA of a USPAP violation. I would note it as "The prior sale within the past 3 years for subject was not disclosed, which is a USPAP requirement."

The client can pursue it further if they wish as a violation complaint

A few years ago a reviewer turned in an appraiser to the board. The board then asked for the review. The board sanctioned both of them.
I sued a Reviewer once in a Los Angeles County Civil Court and won $15,000 in damages.. Guess who didn't show up to defend him ? The Lender that had engaged his services to do the review . They threw him under the bus and their legal council said he had not been engaged to pass around my report to other Non-Users and they were his only Client. The POS learned sometimes you just don't want to screw with some people especially when his family also owned a well known Los Angeles Real Estate and Business Law firm :)

What about the part of USPAP that discusses 'misleading' or 'not credible' report?

Looks to me like the number of mistakes qualifies it as a misleading appraisal report.

Doubtful the lender will send it to the state. I would if I was in your shoes. Someone in higher authority needs to 'have a talk' with this appraiser.

You are so lame the LA Times does not report Civil Cases about small disputes between people. Only high profile crimes and things of general interest There are thousands of Civil cases each month in our County of almost 10 Million People . Where eh hell do you live in a Village in the Rocky's where mail is delivered by
Pack Mules and you read who got divorced that week :)
